Probate law can generally be divided into three parts, the preparation of wills and trusts during one’s lifetime and the administration of the estate and litigation of contested issues after the estate goes into probate.
In order to be sure that your estate is distributed the way that you want it to be distributed, it is necessary to have a properly prepared will. The administration of the estate is the management of the estate assets, the making of the required distributions, the handling of claims for and against the estate and the various reporting to the Court that is required under the law. On occasions wills are contested by family members who believe that the deceased person was taken advantage of or left property to persons against his true wishes.
There are also some often overlooked opportunities to dispense with administration in smaller estates and to informally settle even the most complicated of estates.
