Wrongful death is a type of personal injury. It occurs when someone loses their life due to the negligence or the intentional act of another person or entity, like a company. Claims for personal injury and death may be combined in one action. An example of that situation would be where the deceased was injured but only later passes away as a result of the injuries.
In order to commence a wrongful death action, you must first have a personal representative for the deceased’s estate appointed by the probate division of the District Court. He or she might be the person named in the decedent’s will or some other family member who seeks to be the administrator. The wrongful death statute then sets out how any money received is to be distributed.
